Draft for a lawyer’s review. Not yet in force. Written on 3/11/2026 to sit behind the enquiry page; it needs checking before Lotscape takes enquiries online.
Enquiry terms
Version 2026-11-03 · Last updated 3/11/2026
In short. You keep what you send. I use it to reply, to quote and to make what we agree. What Lotscape makes is concept only: layouts, plans and visuals with no strings attached, for your own due diligence. It isn’t engineering design, a survey or consent documentation, and it carries no professional indemnity, so have your own engineer or surveyor check anything before you rely on it. New Zealand law applies.
1. Who these terms are with
Lotscape is provided by Oliver Rose, trading as SkySync, of Christchurch, New Zealand (“I” or “me”). Contact: oliver@lotscape.co.nz. If you send an enquiry for an organisation, you confirm you are able to agree to these terms for it.
2. What they cover
These terms apply when you send an enquiry through the Lotscape enquiry page, by email or by link, and to any concept work I make for you. If I quote for paid work, the quote and these terms apply together; where a quote or agreement we both sign says something different, it wins. The privacy notice explains how I handle personal information.
3. Your authority to share
You confirm you’re allowed to share what you send, and that doing so doesn’t breach a confidentiality duty, a contract or anyone’s rights. If it belongs to a client, an employer or another owner of the land, you confirm you have their permission. Please don’t send anything you aren’t sure about.
4. You keep what you send
Everything you send stays yours, or stays with whoever owns it now. You give me a non-exclusive licence to store it, copy it and use it for the purposes below. That licence ends when I delete it, apart from improvements already made to Lotscape that don’t contain your material.
5. What I use it for
- to reply to you, work out whether I can help, and quote;
- to make the work we agree and present it to you and the people you name;
- to improve Lotscape’s methods, defaults and checks. That doesn’t mean showing your site, or any part of it, to anyone else.
I won’t publish your site or use it as an example unless you agree in writing and have approved what is shown.
6. Concept only
Everything Lotscape makes, including layouts, lot yields, plan sheets, quantities, levels, services, renders, films, 3D tours, augmented reality views and house placements, is concept information.
- It is built on what you send and on public data, such as LiDAR, aerial imagery, parcel and district plan maps. Public data has its own errors, age and gaps. Anything assumed is named on the sheets.
- It isn’t engineering design, a survey, a geotechnical or hazard assessment, a scheme plan for a resource consent under the Resource Management Act 1991, a design for a building consent under the Building Act 2004, a valuation, or financial advice. It doesn’t mean a council will approve anything.
- I don’t provide producer statements or professional sign-off for it, and it carries no professional indemnity insurance.
- Before anyone relies on it, to buy, borrow, sell, design, apply for consent or build, you need your own due diligence, and a suitably qualified engineer, surveyor or planner must check it and take responsibility for the design.
7. Augmented reality on site
If you view a scheme on site through your phone, stay aware of your surroundings: traffic, drop-offs, water, livestock and machinery. Only go on land you’re allowed to be on. The view is placed from your phone’s GPS and sensors and can be metres out. Never use it to set anything out, to find a boundary, or to locate buried services; before you dig, use beforeUdig and a qualified locator.
8. No strings attached
There’s no obligation either way. I can decline an enquiry, and you don’t have to do anything with what I make. You can use the concept work for your own purposes, such as your due diligence, a conversation with a lender or buyer, briefing a designer or showing your family, as long as the concept-only notices stay on it.
9. Fees
Sending an enquiry is free. If I offer paid work, I’ll quote in writing first, and nothing is charged unless you accept the quote.
10. Who owns what
Your own material stays yours. You can use, copy and adapt what I make for you for your project, with the people you work with on it. Lotscape’s software, templates, standard notes, title blocks, details, and drawing and render styles stay mine. The data source attributions on the work must stay with it.
11. No warranty, and limits on liability
To the extent the law allows, I give no warranty that concept work is accurate, complete or fit for any purpose. I’m not liable for any loss arising from relying on it, including loss of profit, data or opportunity, or any indirect or consequential loss, however it arises, including in negligence. If I am found liable despite this, my total liability to you is limited to the fee you paid for the work concerned, or NZ$100 where there was no fee.
12. Your rights under New Zealand law
Nothing in these terms takes away a right you have under law that can’t be excluded. If you are dealing with me as a consumer, for example building your own home, the Consumer Guarantees Act 1993 may apply to you.
If you are dealing with me in trade, for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply (section 43) and that, as parties in trade, sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply (section 5D), and that it is fair and reasonable for us both to be bound by this clause.
13. Deleting what you sent
Email oliver@lotscape.co.nz with your reference and I’ll delete what you sent.
14. Changes, law and disputes
I may update these terms. The version and date are at the top of this page, and the version you agreed to is kept with your enquiry. These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. If something isn’t right, please email me first and we’ll try to sort it out.
